6. ACCESS AND REGISTRATION ON THE WEBSITE

The risks of the products will be at your expense from the moment of their delivery.

You will acquire ownership of the products when we receive full payment of all amounts due in relation to them, including shipping costs, or at the time of delivery if it takes place at a later time.

9. PRICE AND PAYMENT METHODS

Payment methods

10. SHIPPING AND DELIVERY TIMES

  2. Shipping costs: Shipping costs will be calculated based on the weight/volume of the order and the delivery address. They will be shown clearly before order confirmation.

  3. Delivery times: The estimated shipping times for products in stock are 2-5 business days for shipments within mainland Spain and the Balearic Islands. These deadlines are indicative and could be affected by force majeure or circumstances not attributable to THREE STONES PRODUCTOS Y DISEÑOS SL.

  4. Delivery: Delivery will be made to the address indicated by the User. If delivery is not possible due to the absence of the recipient, the transport agency will attempt a second delivery or will leave a notice for collection at its facilities.

  5. Risk: The transfer of risk for loss or deterioration of the goods will occur when the Client or a third party indicated by them, other than the carrier, has acquired material possession of the goods.

It is the Client’s responsibility to verify the condition of the merchandise upon receipt and to indicate any anomalies on the delivery receipt.

It is the Client’s obligation to keep a signed copy of the delivery documentation provided by the transport company.

 

11. RIGHT OF WITHDRAWAL

 

If you are contracting as a consumer and user, you have the right to withdraw from this contract within a period of 14 calendar days without the need for justification. The withdrawal period will expire 14 calendar days from the day on which the User or a third party indicated by them, other than the carrier, acquired material possession of the goods.

The Client may exercise the right of withdrawal by communicating their decision to withdraw from the contract, by means of an unequivocal statement, through the following channels:

  1. By contacting the Customer Service department at +34917554415, where they will be instructed on the steps to follow.

  2. By sending an email to contact@knightmodels.com, communicating your decision to withdraw from the contract. In the email, you must indicate the order number and the reference of the product you wish to return (in case of partial returns of an order). Within the next 24 hours, the Client will receive the necessary instructions to proceed with the return.

To meet the withdrawal deadline, it is sufficient that the communication regarding the exercise of this right on your part is sent before the corresponding deadline expires.

Product return

For the purposes of exercising the right of withdrawal, it is necessary that the products are returned in the same condition in which you received them, with their original packaging, with all their accessories, and with the instructions and other documents that may accompany them, to the address AV. DE LA INDUSTRIA 6-8 NAVE 14 28108 ALCOBENDAS, MADRID, without undue delay and, in any case, no later than 14 calendar days from the date on which you communicate your decision to withdraw. The Client must bear the direct cost of returning the goods subject to withdrawal.

Once the returned merchandise has been received and verified, THREE STONES PRODUCTOS Y DISEÑOS SL will refund the Client the price of the products subject to withdrawal and the shipping costs, although the return costs of the aforementioned products will be borne by the Client. The refund will be made using the same payment method with which the product was purchased, unless the Client has expressly arranged otherwise.

The refund of the amount corresponding to the withdrawal will be made within a period of 14 calendar days from the date on which the decision to withdraw from the contract has been effectively and unequivocally communicated and provided that the goods or products subject to withdrawal have been received beforehand. Otherwise, the disbursement may be withheld until the receipt of said goods or until the Client proves the return of the goods.

 

No refund will be made if the product has been used beyond its mere opening, for products that are not in the same condition as when they were delivered, or that have suffered any damage, so you must be careful with the product(s) while they are in your possession.

If we receive an item outside the stipulated period, in poor condition, with incorrect content, or that, in short, does not meet the characteristics to be able to withdraw from the contract, you will not be entitled to a refund of amounts. We will contact you, and if after two months from when we make the item available to you, you have not collected it or have refused to receive it, we will not be responsible for it and it will be considered abandoned. We will be authorized to pass on the corresponding costs to you if it is possible to manage the return of the package to your attention.

 

Before returning the product, the Client must ensure that it is properly protected and sealed so that it does not suffer any damage during transport.

THREE STONES PRODUCTOS Y DISEÑOS SL is exempt from all liability for the products until they are delivered by the carrier to its facilities.

Exceptions to the Right of Withdrawal

You will not have the right to withdraw from a contract whose object is the supply of any of the following products:

  • The supply of goods or provision of services made to the consumer’s specifications or clearly personalized.

  • The supply of goods that are liable to deteriorate or expire rapidly.

  • The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and were unsealed after delivery.

  • The supply of goods which are, after delivery, according to their nature, inseparably mixed with other items.

  • The supply of sealed audio or sealed video recordings or sealed computer software that were unsealed by the Client after delivery.

 

12. WARRANTIES

 

All new products offered on the website have a legal warranty of three years from the date of delivery, in accordance with current regulations. In the case of second-hand products, the warranty will be one year.

If you contract as a consumer and user, you have the right to corrective measures, free of charge, in case of non-conformity of the goods. We offer you guarantees on the products we sell through this website, in the terms legally established for each type of product, and we are therefore responsible for any lack of conformity of the same that becomes apparent within a period of three years from the delivery of the product.

It is understood that the products are in conformity with the contract provided that (i) they conform to the description we have made and possess the qualities we have presented on this website, (ii) they are suitable for the purposes for which products of the same type are ordinarily intended, and (iii) they present the usual quality and performance of a product of the same type that are reasonably expected.

In this sense, if any of the products are not in conformity with the contract, the Client must notify THREE STONES PRODUCTOS Y DISEÑOS SL within two months of becoming aware of it, through the email address contact@knightmodels.com, and must inform of the nature of the problem, the time, and the conditions of its appearance.

In case of non-conformity, THREE STONES PRODUCTOS Y DISEÑOS SL will replace or repair the product, whenever possible, at no cost to the Client. In the event that the product cannot be replaced due to availability, a full refund of the purchase will be made.

For the processing of warranties, the Client must contact the Customer Service at +34917554415, during the following hours: Monday to Friday, business days from 10:00 to 14:00.

The product warranty will not be applicable if any of the following causes occur:

  • Natural wear and tear of the product.

  • Inappropriate use, abuse, negligence, or accidents, whatever their cause. Use of the product other than that specified in the documentation and/or instructions provided by the manufacturer in relation to the product will be understood to be included within inappropriate use or abuse.

  • Inappropriate test, operation, maintenance, or installation operations, or any alteration or modification. Inappropriate operations will be understood to include those not carried out by the manufacturer or by personnel expressly authorized by it.

  • Incorrect use, handling, maintenance, or wear and tear with use by the Client or any defect/breakdown in which the Client has been involved.

  • Damage caused by natural disasters, floods, fire, or accidents.

  • Software problems, viruses, IMEI loss, configuration errors, or software incompatibilities caused directly or indirectly by the Client.

  • Broken or damaged components subjected to impact (blows), overpressure or humidity, spillage or pouring of liquids and/or food on the product, appearance of corrosion and/or rust on the product, use of an incorrect voltage with the product.

  • Any unauthorized disassembly, repair, alteration, or modification carried out on the product by the Client or by unauthorized technicians.

  • Deterioration, removal, or concealment, by the Client, of the warranty label or the manufacturer’s serial number label of all products.

  • Scratches or damage to the plastic surfaces and all other externally exposed parts of the product.

Consumables or accessories or those elements that may have aesthetic damage due to use are excluded from the general warranty.
